The CMS proposed that drug manufacturers be required to disclose the list prices of drugs covered by Medicare or Medicaid in TV ads. In particular, manufacturers would have to include a product’s monthly wholesale price or the cost for a typical course of treatment if it is greater than $35 for 30 days. TV ads would also need to include a statement explaining that patients with health insurance may pay a different amount since list prices are typically used as a starting point for rebate and discount negotiations.
