A recent Steptoe & Johnson memo “reviews and evaluates the Cybersecurity Information Sharing Act of 2015 (S. –)(“CISA”) drafted by Senators Richard Burr (R-NC) and Dianne Feinstein (D-CA) and the Cyber Threat Sharing Act (S. 456), introduced by Senator Thomas Carper (D-DE).”
It evaluates the bills on three criteria:
(1) Are the information sharing incentives in the bill sufficient?
(2) Are the bill’s liability provisions sufficiently fulsome to encourage information sharing?
(3) To what degree could the insurance industry use the shared data for risk management and insurance underwriting purposes?
